The present bail application has been filed by the petitioner, under Section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, seeking grant of Regular Bail in FIR No. 701/2020 dated 28.11.2020 for the offence punishable under Section 365 of the Indian Penal Code, 1860, registered at Police Station Bawana, Delhi. The learned counsel for the petitioner seeks permission to withdraw the present bail application with liberty to file afresh after the testimony of PW-4 is concluded. He further submits that the statement of PW-4, though partially recorded in examination-in-chief, has not been concluded for the past three years. 5.

The learned APP submits that she will ensure the presence of PW-4 before the learned Trial Court and that his examination is concluded.

In view of the above, the permission and liberty, as prayed for, in accordance with law, is granted.

The present bail application is, accordingly, dismissed as withdrawn.
