As reflected from record, the petitioner has already passed away and his legal representatives have restored possession of the subject premises to the respondent/landlord. Apparently for that reason, the respondent has not been appearing. At the same time, learned counsel for petitioner has also filed the application CM 3302/2024 seeking discharge. The said application is accompanied with registered letter addressed to the petitioner, though as per record, the petitioner has already passed away. Even on behalf of legal representatives of the petitioner, none has been appearing, which could be because the possession has already been restored by them to the respondent.
