Learned counsel for the respondent No.1 submits that since the matter is pending before learned CMM, the respondent No.1 will not take any step to recover the possession till the order is passed on the subject. 2.

Learned counsel for the petitioner submits that in view of the assurance given by learned counsel for the respondent No.1, he may be permitted to withdraw the present writ petition with liberty to avail the appropriate remedy as per the law after the order is passed by learned CMM. 3.
