Considering that the penalty imposed on the Petitioner as evident from the impugned order is a minor penalty and the Tribunal has correctly noted that it has no jurisdiction to entertain any challenge to such penalty, Mr.Peeyoosh Kalra, learned counsel for the Petitioner, on instructions, seeks to withdraw the present petition to file a fresh petition in accordance with law, in an appropriate forum.

The petition is accordingly disposed of as withdrawn with liberty as prayed for, in accordance with law. Needless to say, if the Petitioner resorts to a legal remedy, the factum of filing this petition will be taken into consideration if any question on delay and laches arises.
