Besides this petition, several other proceedings were pending between the parties and the counsel for the petitioners has in Court handed over a copy of the order dated 24th July, 2017 in CM(M) No.1253/2016 tiled Vijay Arora Vs. Ashish Sahni of this Court recording the compromise in the suit from which the aforesaid petition CM(M) No.1253/2016 arose, and in this petition and it is inter alia recorded therein that on the parties being bound by their statements as contained in the Settlement Agreement dated 14th July, 2017 and the respondent herein Vijay Arora withdrawing his objections in the present petition, there would be no need for the petitioner herein to obtain probate. The Settlement Agreement and the order dated 24th July, 2017 supra also record the statement of the respondent herein Vijay Arora and his counsel withdrawing the objections filed in the present petition and the order dated 24th July, 2017 also binds the parties thereto and who are the parties to this petition also with the Settlement Agreement dated 14th July, 2017.

Though none appears for the respondent Vijay Arora today but Vijay Arora has already withdrawn his objections to this petition and which are dismissed as withdrawn.

This petition is disposed of in terms of Settlement Agreement dated 14th July, 2017 and the order dated 24th July, 2017 supra. 4.

The original documents, if any, be returned to the respective parties in accordance with law.

No costs.
