The present petition under article 226 of Constitution of India r/w section 482 of Cr.P.C. seeking quashing of criminal proceeding arising out of FIR No. 0046/2024 P.S. Connaught Place U/S 323/341/34 IPC dated 19.02.2024.

The FIR was lodged on the statement of respondent No.3 alleging that he was attacked by petitioners.

However, now the parties have reached on a settlement vide MOU dated 18.05.2024 on the following terms and conditions: "1 That it is agreed that second party will file compounding application / or the Quashing petition before Hon'ble Courts of Delhi and First party under takes to cooperate with the Second party for compounding/ Quashing of FIR. 2 It is also agreed that after the enforcement of this deed neither the party shall have any concern regarding the personal/social and legal aspect of other party. 3 That the parties have also undertaken that after the present settlement they shall live peacefully and shall not make any other claim against each other in future regarding the/FIR/Complaints P-cases/appeals/Criminal above.

Revision mentioned 4 That the present settlement has been arrived at between the parties without any force and coercion. This settlement is out of their free will.

5 That the Parties will request the Hon'ble Court to disposeoff the above mentioned cases in terms of the settlement. By signing this Memorandum of Understanding the parties hereto state that they will have no further claims or demands against each other by the parties hereto That the parties undertake before the Hon'ble Court to abide by the terms and conditions set out hereinabove and not to dispute the same hereinafter in future." 6.

The perusal of the FIR indicates that it was sudden quarrel amongst the parties.

On behalf of State it has been submitted that they have reached on a settlement amicably.

In view of the above, the FIR NO. 0046/2024 P.S. Connaught Place U/S 323/341/34 IPC and the proceedings emanating therefrom are quashed.
