This is a petition filed under Section 29A(5) of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitral Tribunal by a further period of 6 months from the date of disposal of the present petition to make and pass the final Award. 2.

Ms. Rana, learned counsel for the petitioner states that the only issue remaining is with regard to the interest payable by the respondent to the petitioner and determination of costs, as the Arbitral Tribunal has already awarded claim amounts in favour of the petitioner vide an Interim Award dated 10.04.2023.

She states that no new witness is to be examined, as the petitioner will only argue the interest claim before the Arbitral tribunal. She further states that since main claims had already been adjudicated, the petitioner was contemplating whether to proceed, which took some time and hence, the delay.

Mr. Kumar, learned counsel for the respondent states that the petitioner seeks to examine a new witness. He further states that the present petition has been filed after a period of one year since the expiry of the mandate of the Arbitral Tribunal and such delay has not been explained. 5.

In the present case, the parties have been before the Arbitral Tribunal since 2019 and the parties have expended valuable time, effort, energy and resources. Additionally, only the issue of interest and costs is remaining and no new witness is being examined. 6.

I am of the view that sufficient cause has been explained for the delay. In view of the aforesaid, the petition is allowed and the mandate of the Arbitral Tribunal is extended by a period of 6 months from today. 7.

The period from 10.07.2024 till today stands regularised. 8.
