An application under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of petitioner for grant of regular bail in FIR No. 348/2022 under Sections 20C/25/29 of NDPS Act registered at P.S.: Nihal Vihar. 2.

Learned counsel for petitioner submits that NBWs were directed to be issued against the petitioner after he was granted regular bail since he failed to appear before the learned Trial Court on 11.12.2023. He further submits that the next date of hearing was fixed before the learned Trial Court on 19.04.2024 but before the said date, the petitioner was arrested on 14.04.2024.

On the other hand, application is opposed by learned APP for the State though the factual position is not disputed. 4.

Petitioner is in custody since 14.04.2024. Considering the totality of facts and circumstances, since the petitioner was already granted regular bail BAIL APPLN. 2593/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. by learned Trial Court vide order dated 14.07.2023, he is admitted to bail on furnishing a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the learned Trial Court and subject to the following conditions: (i) Petitioner shall provide his mobile number to the Investigating Officer (IO)/SHO concerned at the time of release. (ii) Petitioner shall appear before the learned Trial Court as and when directed.

Application is accordingly disposed of. Pending applications, if any, also stand disposed of.

A copy of this order be forwarded to the learned Trial Court and Superintendent Jail for information.
