Status report has been filed on behalf of the respondent-MCD. 1.1.

However, the same is not on record.

A copy of the said status report has been handed over in Court today and the same is taken on record.

In terms of the status report, no construction activity is taking place in the shop bearing no. A-31/H, Main Road, Maujpur, Delhi-110053 (hereinafter the 'subject property'). It is further stated that the shop is old and currently occupied.

The dispute in the present writ petition is with regard to a wall adjoining the school which the petitioner claims belongs to its school. 5.

On the other hand, the respondent no.5 contends that the wall is not part of the school and has been in existence and part of the shop since 2002. 6.

These are disputed questions of facts which cannot be decided in the present writ petition.

Accordingly, the present writ petition is disposed of while giving liberty to the petitioner to invoke appropriate remedies as available in law.
