O R D E R

% 09.03.2019 Parties have mutually agreed to resolve the subject matter and thereunder, the respondent Insurance company has agreed to pay a sum of Rs.13,00,000/- (Rupees Thirteen lakhs only), over and above the amount payable in terms of the impugned award, towards full and final settlement. The settled amount of Rs. 13 lakhs shall be deposited by the insurance company by way of cheque/demand draft with the DHCLSC, within four weeks from today, failing which, it shall carry interest at the rate of 9 per cent per annum.

Out of the settled amount, Rs.1,30,000/- (Rupees One Lakh Thirty

Thousand Only) shall be released by the DHCLSC to the appellant-claimant, subject to verification. Remaining balance settled amount shall be kept in an FDR in a nationalised bank for a period of five years in consonance with the terms of the award. However, interest accruing thereon, be released on monthly or yearly basis, as may be beneficial and desired by the claimant. The impugned award stands modified to that effect. Consequently, the appeal shall stand disposed of.
