CRL.M.C. 5647/2024 (under Section 482 CrPC filed by the petitioner for setting aside the impugned Order dated 16.02.2024) 3.

The Petition under Section 482 CrPC has been filed on behalf of the petitioner for setting aside the impugned Order dated 16.02.2024, passed by learned Metropolitan Magistrate, vide which the petitioner has been directed to join the proceedings physically on the next date i.e. 20.03.2024. 4.

the petitioner had already appeared before the learned Metropolitan Magistrate and he intends to actually challenge the summoning and wants the quashing of the complaint.

Learned counsel for the petitioner seeks permission to withdraw the Petition with liberty to file a fresh Petition before the appropriate forum. 6.

The Petition is permitted to be withdrawn with liberty as prayed for. 7.

The Petition is disposed of accordingly.
