Heard the learned counsel for the parties.

Learned counsel representing the tendering authority- the Medical Superintendent, VMMC & Safdarjung Hospital has handed over to the Bench, written instructions as contained in the letter dated 13.08.2025 communicated by the Medical Superintendent of the said hospital which states that the tendering authority shall place the order for 24000 pieces in Bid No. GEM/2024/B/5234419 dated 08.08.2024 for which the petitioner i.e. Durga Surgical Corporation is already L-1. tendering authority shall procure 1/4th of the bid quantity of the bids mentioned in the said letter from petitioner upon an undertaking that it shall supply the products on Last Purchase Price subject to its sample being found acceptable as per specification of the bid item. The letter dated 13.08.2025 is extracted hereinabove.

Dated-13.08.2025 Instructions in WP(C) 9783/2025 titled Durga Surgical Corporation Vs Union of India pending before the Hon'ble High Court of Delhi. You (Mr. Vikrant Goyal, Govt. Counsel) may apprise the Hon'ble Court of the following:

1. That we shall place order for Qty-24000 pcs. In Bid No. GEM/2024/B/5234419, Dated 08.08.2024 for which petitioner i.e. M/s. Durga Surgical Corporation is already as L-1.

2. We shall procure 1/4 the of the Bid quantity of the following Bids from the petitioner upon his undertaking that he shall supply the product at the Last Purchase Price subject to his sample found acceptable as per specification of the bid item.

(i) Bid No. GEM/2025/B/5886184, Dated: 30-01-2025 (Item- Cotton Bandage Cloth, 15 cm x 4 mtr.), (ii) GEM/2025/B/5969544, Dated: 01-03-2025 (Crepe Bandage, Asstt. size) (iii) GEM/2025/B/5936544, Dated: 01-03-2025 (Absorbent Cotton Guaze, 60 cm x 20 mtr.) (iv) GEM/2025/B/6078816, Dated 09-04-2025(Cotton Bandage Cloth/Starch Bandage, 15 cm x 4 mtr.) Medical Superintendent Safdarjung Hospital"

Learned counsel for the petitioner, learned counsel representing the respondent no.8 as also the learned counsel representing the respondent nos.4 and 6 have no objection, if the petition is decided in terms of the above averments made in the letter dated 13.08.2025. 5.

Accordingly, the writ petition is decided in terms of the undertaking as contained in letter of the Medical Superintendent, Safdarjung Hospital, dated 13.08.2025.

Petition stands disposed of.

Pending applications also stand disposed of.
