The present bail application has been filed under Section 438 Cr.P.C. seeking anticipatory bail in FIR No. 105/2022 registered under Sections 420/34 IPC at Police Station Cyber Police Station South, Delhi. 2.

Learned counsel for the petitioner/applicant states that the total alleged cheated amount is about Rs.10 lacs, though learned counsel for the complainant has disputed the same and stated that an amount of approximately Rs.19 lacs has been cheated. Learned counsel for the applicant further states that only Rs.6.10 lacs have been shown to be transferred to the account of present applicant. 3.

a sum of Rs.5 lacs to the complainant's account. Learned counsel for the complainant, who is present in the Court, confirms the same. 4.

Looking into the aforesaid facts and circumstances, it is hereby directed that in the event of arrest, the applicant be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station and also subject to the following further conditions:

i) The applicant shall remain available on mobile number i.e., 7358439933, which he undertakes to keep operational at all times during the trial ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO iii) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence iv) The applicant shall join the investigation and shall appear before the Trial Court as and when chargesheet is filed. At the first instance, the applicant shall join the investigation on 02.02.2024 5.

The application stands disposed of in above terms. 6.

Needless to state that nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case.
