The petitioner was a candidate for the post of Trained Graduate Teacher- Science, pursuant to an advertisement issued by respondent No. 2/ National Education Society for Tribal Students ["NESTS"] on 28.06.2023 for recruitments to various teaching and non-teaching posts in Eklavya Model Residential School. His candidature was in the category of Persons with Benchmark Disabilities -Orthopedically Handicapped. 2.

The petitioner's grievance is that, after issuance of a provisional appointment letter on 02.03.2024, his candidature was rejected by the impugned communication dated 25.06.2024 on the ground that his disability was not in the category as listed in the aforesaid notification of W.P.(C) 9801/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. NESTS dated 28.06.2023.

Mr. Amartya Ashish Sharan, learned counsel for the NESTS, who appears on advance notice, states, upon instructions, that NESTS is willing to reconsider the petitioner's candidature and will not reject his candidature on this ground.

In this view of the matter, no further orders are required in the present writ petition.

NESTS is directed to issue a final appointment letter and posting order to the petitioner within a period of 3 months, if he is otherwise eligible.

The writ petition, alongwith the pending applications, is disposed of in the aforesaid terms.
