The appellants/defendants are aggrieved by an order dated 08.08.2019, passed by learned Single Judge allowing an application filed by the respondent/plaintiff under Order 12 Rule 6 of the CPC on the basis of the admissions made by them in their written statement in respect of premises No. C-9/95, Sector-8, Rohini, Delhi and Flat No. AC-1/178C, Shalimar Bagh, Delhi.

After addressing arguments at some length, Mr. Pawan Bahl, learned counsel appearing for the appellants/defendants seeks leave to withdraw the present appeal while reserving the right of the appellants/defendants to take appropriate legal recourse against the respondent/plaintiff for seeking compensation towards the money purportedly spent by them exclusively on raising a construction on the plot of land situated at Rohini. RFA(OS) 89/2019
