This is a petition filed under Section 14 of the Arbitration and Conciliation Act, 1996 seeking appointment of a fresh Arbitrator. 2.

After hearing some arguments, learned counsel for the petitioner and the respondents are agreeable to appointment of a new Arbitrator. Parties have no objection to the same.

For the said reasons, the petition is allowed and the following directions are issued:- i) The mandate of Mr. Ravinder Kumar Raina, earlier Arbitrator stands terminated.

ii) Dr.

Kamini Lau, District Judge (Retd.) (Mob.

9910384715) is appointed as a fresh Sole Arbitrator to adjudicate the disputes between the parties.

iii) The arbitration will be held under the aegis and rules of the Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi (hereinafter, referred to as the 'DIAC').

evidence of the claimant.

v) The respondents shall be entitled to file a fresh application under Section 16 which will be adjudicated upon its own merits without being influenced by the earlier order dated 11.01.2024.

vi) The remuneration of the learned Arbitrator shall be in terms of DIAC (Administrative Cost and Arbitrators' Fees) Rules, 2018.

vii) The appropriate Fee schedule from the stage of issues as per the DIAC will apply.

viii) Interim directions given under Section 17 application shall continue until varied, modified or set aside by the Competent Court.

ix) It is made clear that all the rights and contentions of the parties, including as to the arbitrability of any of the claim, any other preliminary objection, as well as claims/counter-claims and merits of the dispute of either of the parties, are left open for adjudication by the learned arbitrator.

x) The parties shall approach the learned Arbitrator within two weeks from today.
