CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA
O R D E R
% 12.10.2017 I.A. Nos. 11792/2017 (under Section 151 CPC), 11794/2017 (for delay) and 11793/2017 (for exemption) 1.
A perusal of the record reveals that two vakalatnamas were signed by the plaintiff in favour of Mr. Arvind Kumar Tiwary, Advocate who continuously appeared for him since January, 2011 except for one date when Ms. Priyanka appeared on 4th August, 2014. The suit was also withdrawn by Mr. Arvind Kumar Tiwary, Advocate. In view of this position, the averments of the plaintiff in the application that he never engaged Mr. Arvind Kumar Tiwary, Advocate but had engaged one Mr. Ajit Singh, Advocate does not seem to be plausible. 2.
Learned counsel for the plaintiff seeks an adjournment to place on record material to show that the plaintiff was in contact and conversation only with Mr. Ajit Singh, Advocate at the relevant time and never contacted Mr. Arvind Kumar Tiwary, Advocate.
3.
At request, list on 12th December, 2017.
