The counsel for the petitioner states that the petition can be disposed of in terms of the letter dated 16th February, 2016 of the Ministry of Youth Affairs & Sports, Govt. of India filed along with the counter affidavit of the respondent No.3 Mr. Pankaj Lochan Mohanty.

The said counter affidavit is not on record and reported to be lying under objection.

A copy of the letter dated 16th February, 2016 is handed over in the Court and is taken on record.

As per the said letter, both the factions of Amateur Baseball Federation of India (ABFI) have been advised to finalise a suitable person who can function as a Returning Officer and if both are not able to arrive at a common name, advising both of them to suggest two or three names W.P.(C) 1224/2016
preferably of retired High Court Judges who can be appointed as the Returning Officer for holding the election.

The counsel for the petitioner representing one of the factions of ABFI states that this Court may appoint any retired High Court Judge as the Returning Officer.

The counsel for the respondent No.3 representing the other faction, however is not agreeable and states that he will give the names in accordance with the said letter to Union of India (UOI) within one week i.e. on or before 6th May, 2016.

The petitioner may also submit the names proposed by the petitioner within the said time of one week.

The petition is disposed of with a direction to the UOI to appoint the Returning Officer on or before 13th May, 2016 and to ensure that the elections are held on or before 31st August, 2016. If the names of the Returning Officer are not provided within the prescribed time, the UOI is at liberty to proceed with the appointment of the Returning Officer. No costs.
Copy of this order be given dasti under the signatures of the Court Master.
