% 22.01.2018 CO.APPL. 140/2018 1) This is an application made by the applicant/petitioner seeking restoration of CO.PET. 185/2014, which was disposed of via order dated 16 May 2016. A perusal of the said order shows that the learned Judge had given to permission to the petitioner to institute fresh notice as per law in case of violation of the terms of the agreement arrived at between the applicant and the respondent. In these circumstances this application cannot proceed further. 2) At this stage, counsel for the applicant-petitioner seeks to withdraw the application and says that, if necessary, he will file a fresh company petition. Consequently, the application is dismissed as withdrawn with liberty to file a fresh proceeding, albeit, in accordance with law.
