The petitioner filed eviction petition bearing no. E-35/16 (new no. 80054/16) titled as Mustajabuddin V Viqar Ahmed under section 14(1)(e) read with section 25B of the Delhi Rent Control Act, 1958 ("DRC Act"). 2.

The respondent, after service of summons as per the Third Schedule, filed an application under section 25B (4) & (5) of DRC Act for leave to defend alongwith affidavit, which was allowed vide order dated 18.02.2019. 3.

The petitioner being aggrieved by the order dated 18.02.2019, filed the present petition.

Mr. S.S. Nizami, Advocate for the petitioner stated that before the trial court, evidence of the petitioner has already been commenced and the present petition be disposed of with direction to the trial court to conclude the trial within a span of 06 to 09 months including pronouncement of judgment.

Accordingly, the present petition is disposed of with the direction to the trial court to make an endeavour to conclude the trial within a span of 06 to 09 months including pronouncement of judgment. 7.

The respective counsel for the petitioner and the respondent are also directed to cooperate in the trial and shall not seek any adjournment without any justifiable reason.
