The present petition has been preferred under Section 36(1) and

(2) of the Arbitration and Conciliation Act, 1996, seeking enforcement of the Award dated 13.11.2018.

The Judgment Debtor company is stated to have been admitted to the corporate insolvency resolution process under the Insolvency and Bankruptcy Code, 2016.

Learned counsel for the parties are ad idem that the present petition may be disposed of with directions that, in the event the resolution process does not culminate in a determination of the claims of the parties or otherwise remains indeterminate, thereby necessitating the Decree Holder to pursue enforcement of the award against the Judgment Debtor, appropriate liberty be reserved. 5.
