% 22.01.2018 CO.APPL. 139/2018 1) This is an application made by the applicant/petitioner seeking restoration of CO.PET. 172/2014. Which was disposed of via order dated 16 May 2016.

2) A perusal of the said order shows that the learned Judge had given to permission to the petitioner to institute fresh proceedings as per law in case of violation of the terms of the agreement arrived at between the applicant and the respondent. In these circumstances this application cannot proceed further. 3) At this stage, counsel for the applicant petitioner seeks to withdraw the application, and says that, if necessary, he file a fresh company petition. The liberty can however be exercised in

accordance with law. Consequently, the application is dismissed as withdrawn with liberty to file fresh proceedings, albeit, in accordance with law.
