% 12.04.2018 Complainant has alleged in the FIR that he had advanced friendly loan of `7,40,000/- to the petitioner. To discharge his legal liability, petitioner issued cheque for `7,40,000/- in the name of complainant.
However, on presentation, the cheque was returned dishonoured with the remarks 'payment stopped by drawer'. Learned counsel for the petitioner submits that petitioner had not issued any cheque to complainant. Petitioner had taken loan from one Sher Singh and had handed over him signed blank cheques and one of such signed blank cheque has been manipulated by the complainant. Petitioner has repaid the loan amount to said Sh. Sher Singh.
Petitioner has joined the investigations in as much as he has paid `4 lacs to complainant.
Keeping in mind the totality of facts and circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
