The present petition under Section 482 Cr.P.C has been filed by the Petitioner challenging the Order dated 03.09.2022 by which the Ld. MM has recalled the Order dated 26.03.2022 by which the Respondent was directed to proceed ex-parte.

On 03.09.2022, Ld. Trial Court find that the there are sufficient reasons as to why the Order dated 26.03.2022 should be recalled. 3.

After some arguments, learned Counsel for the Petitioner states that he does not wish to press the present petition, however, he states that since the present matter pertains to payment of maintenance and the application for maintenance was filed in the year 2021 and three years have already passed and the application is not yet decided, the Ld. MM may be requested to proceed as expeditiously as possible.

In view of the fact that the application for maintenance was filed in the year 2021 and 3 years have elapsed and interim maintenance is yet to be decided, the Ld. Trial Court is requested to proceed with the matter expeditiously and decide the application on interim maintenance within a period of six months from today.

With these observations, the petition is disposed of, along with pending application(s), if any. It is made clear that this Court has not made any observations on the merits of the case.
