At the outset, the appearance of the learned counsel appearing for the petitioner, Mr. Sanjeev Sehgal, on 31.10.2023 is taken on record. 2.

The present petition has been filed by the petitioner for de-sealing the property bearing House No.68, Khasra No.420/444-1-3/544-1, Village Dera, New Delhi-110074.

Learned counsel for the MCD, who appears on advance notice, submits that it would be apposite for the petitioner to make request in this regard to the concerned Executive Engineer alongwith an affidavit and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. undertaking to the effect that the petitioner shall not raise any unauthorised construction without getting the building plan sanctioned by the competent authority.

He submits that upon submission of the said application,together with the de-sealing charges,the same shall be duly considered and appropriate order/s shall be passed by the concerned Executive Engineer within a period of two weeks of the receipt thereof.

Learned counsel for the petitioner submits that he shall be approaching the concerned Executive Engineer within a period of one week from today.

Consequently, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach the concerned Executive Engineer of the respondent.

Accordingly, the present petition is dismissed as withdrawn with liberty as prayed for.

The concerned Executive Engineer is directed to expeditiously consider the request of the petitioner for de-sealing of the aforesaid property and pass requisite order/s within a period of two weeks from the date of the receipt of the request in this regard, as already undertaken by the learned counsel for the respondent/MCD.
