1. Exemption allowed, subject to all just exceptions. W.P.(C) 11624/2019 & CM Appl.No. 47772/2019 (stay)

2. The Petitioner was asked by the Central Bureau of Investigation by the impugned order dated 4th September, 2019 to report to the parent Department forthwith.

3. The present petition was filed on 14th October, 2019. Till that date, and even as on date, the Petitioner has not reported back to the parent department. The Court finds this conduct to be unacceptable.

4. Counsel for the Petitioner states that the Petitioner proceeded on medical leave. He is unable to state whether the medical leave was sanctioned either by the CBI or his parent department. In any event, the Court finds that even W.P.(C) 11624/2019 Page 1 of 2

the CBI's request for the Petitioner's absorption in the CBI has been turned down by the Ministry of Home Affairs by its communication dated 12th March, 2018 on the ground that he had not completed 18 years of minimum service in his parent cadre as of that date. The petition is not clear on whether the Petitioner has in fact completed 18 years of minimum service in his parent cadre.

5. In the circumstances, the Court is not inclined to entertain this petition. If and when the Petitioner actually completes 18 years of service in the CRPF, it will be open for him to renew his request for absorption, if it is so permissible in law.

6. The petition is dismissed. The pending application is also disposed of. S. MURALIDHAR, J.
