By way of the present petition filed under Section 482 Cr.P.C, the petitioner seeks to assail the final report dated 02.08.2022 and summoning order dated 28.09.2022, vide which the petitioner has been summoned. 2.

Learned counsel for the petitioner submits that he has been summoned in the capacity of the Managing Director of the firm without impleading the firm. He further states that summoning order is cryptic and does not assign any reason in this regard.

I have gone through the summoning order. The summoning order is cryptic, in as much as, the same only states that the concerned court has perused the file and took cognizance. Needless to note that summoning an accused in a criminal case is a serious matter and the order must reflect some application of mind which is clearly lacking in the present case. Considering the aforesaid, the summoning order is set aside. Let afresh order on summoning be passed.
