% 10.02.2016 Learned counsel for the petitioner submits that petitioner is rendering services for the upliftment and welfare of the legal fraternity and is not engaged in any commercial activity, therefore, the rates as provided under Factor - 1 have to be applied. It is further submitted that similar rates are being applied in respect of UGC, Nursing Council of India, Dental Council of India, Association of Indian Universities etc. Learned counsel for the respondents submits she has got instructions from the respondents that they will consider this contention and pass a fresh order. It is further submitted that respondents have no objection in case impugned orders (Annexure P-1

and Annexure P-2) are set aside and matter is remanded to the respondents for consideration afresh.

With the consent of parties, Annexure P-1 and Annexure P-2 are quashed and matter is remanded to the respondents to consider the matter afresh and pass appropriate orders, after affording the opportunity of hearing to the petitioner. Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
