% 20.03.2018 The matter is listed on the basis of an office note to the following effect:- "Reference order dated 15.09.2017.

In this connection, it is submitted that as per para 9 of the aforesaid judgment a decree has been passed in this case in terms of paras (A) to (C) of Prayer Clause of the plaint. While preparing the decree it has come to the notice that some typographical error has crept in the said judgment i.e. only sub para (i) of para C has been quoted at page 12 of the said judgment instead of quoting C (i),(ii) & (iii). In view of the above, it is submitted for orders as to whether we may list the case before the Hon'ble Court for clarification/directions on 10.01.2018."

In this connection it is noted that vide judgment dated

15.09.2017 the suit of the plaintiff was decreed in favour of the plaintiff in terms of clauses A to C of the prayer clause. It is reported by the office that in the judgment dated 15.09.2017 prayers A, B and prayer (i) of para C of the prayer clause is only mentioned, but the decree is passed for paras A to C of the prayer clause which includes para Nos.(ii) and (iii) of C as well. Since the decree is passed in terms of the clauses A to C of prayer, the decree sheet be prepared in terms of the directions given therein while including sub paras No.(ii) and (iii) of para No.C.
