% 12.03.2025 CS(OS) 718/2014 & CC 43/2016 (by D-12 & 13) 1.

Vide order dated 20.10.2022, the Hon‟ble Court had brought the legal heirs of plaintiff no.2, as detailed in the application bearing IA No. 16996/2018 on record. In the aforesaid application, Sh. Kripa Shanker Saxena, Sh. Gaurav Saxena and Ms. Sonali Saxena are mentioned as legal heirs of plaintiff no.2. All the aforesaid legal heirs of plaintiff no.2 and plaintiff no.1 are present today. 2.

listed today for compliance of the terms of settlement. As per the settlement, it was agreed that the contesting defendants will give a sum of Rs. 56 lakhs to both the plaintiffs i.e. 50% of the amount to plaintiff no.1 and remaining 50% to legal heirs of plaintiff no.2 by way of demand draft.

Demand draft bearing no. 953910 drawn on Canara Bank dated 25.02.2025 of Rs. 27 lakhs has been handed over to plaintiff no.1/Smt. Shashi Saxena today. Demand drafts bearing no.953909, 953907 and 953908 of Rs. 9 lakhs each all dated 25.02.2025 have been handed over to the legal heirs of deceased plaintiff no.2 namely Sh. Kripa Shanker Saxena, Mr. Gaurav Saxena and Ms. Sonali Saxena respectively.

Learned counsels for the parties submit that there has been compliance of settlement recorded on 18.02.2025. The present suit bearing no. 718/2014 be consigned to record room in terms of order of the Hon‟ble Court dated 18.02.2025.

Perusal of record reveals that a counter claim was preferred by defendant nos. 12 & 13 in the present case. Learned counsel for counter claimant submits that he will file an application for withdrawal of the counter claim. Let the needful be done within four weeks.

Re-notify the matter for further proceedings on 11.07.2025.
