The present petition has been filed under Articles 226 and 227 of the Constitution of India seeking setting aside of the impugned order dated 09.10.2019 passed by the Presiding Officer, Labour Court-IX, Rouse Avenue Courts, whereby the application filed for setting aside the order dated 26.08.2019 was dismissed.

Notably, vide the aforesaid order dated 26.08.2019, the appellant/management was proceeded ex-parte.

Learned counsel for the petitioner submits that the application seeking setting aside of the aforesaid order was filed on the very same day. 4.
Learned counsel for the respondent fairly does not oppose the request made on behalf of the petitioner.

In view of the above, the present petition is allowed and the impugned order dated 09.10.2019 is set aside. the petitioner ex parte is also set aside. The matter is remanded to the concerned Labour Court for adjudication in accordance with law. 6.
