O R D E R

% 20.10.2016 CM No. 38097/2016 (for recording compromise) The parties i.e. petitioner and respondent no. 2 had settled the disputes and it was recorded vide order dated 19.04.2016 that the respondent no. 2 and 3 shall hand over the physical vacant possession of the property in question to the petitioner who shall thereafter carry out the repair and renovation work and restore the possession to respondent no. 2 on or before 31.12.2016.

It is contended by the parties, by way of the present application, that the petitioner and respondent no. 2 have resolved all their disputes and respondent no. 2 has relinquished all his rights, title and interest in the tenancy in respect of the said property in favour of the petitioner. The petitioner on account of loss of goodwill in the business has compensated the respondent no. 2 by a sum of Rs. 20 W.P.(C) 1366/2016

lakhs. Counsel for respondent no. 2 acknowledges the receipt of the said amount.

The terms of compromise are contained in paragraph 3 of the application. Learned counsel for parties submit that the said terms be taken on record and the proceedings be disposed of in terms thereof. The terms of the compromise as recommended in the paragraph 3 of the application are taken on record. The statement of the respondent that respondent has relinquished all the claims, title or interest in tenancy rights and has surrendered the same is also taken on record.

The application is accordingly disposed of and proceedings are closed.
