TR.P.(C.) 24/2016 Subject matter of the suit is situated in Safdarjung Enclave, New Delhi which is located in Southern District. The jurisdiction lies with the District and Sessions Judge (South-District), Saket Courts. Vide order dated 21.12.2015 the Coordinate Bench of this Court had transferred this suit to District & Sessions Judge (South-West District), Dwarka Courts noting that the suit property would be lying within the that district; it has been brought to the notice of this Court that this is factually incorrect.

Accordingly, the present suit i.e. CS(OS) No.658/2009 titled Shri Umesh Kumar Bhargava & Anr. Vs. Shri Vijay Bhargava & Ors. is transferred from South-West District to South District. Other

directions contained in the order 21.12.2015 shall be abided by. Parties to appear before the District & Sessions Judge (SouthWest District), Dwarka Courts on 09.3.2016 at 10.30 a.m. who shall pass appropriate order of transfer.

With these directions petition disposed of.
