The Appellant who appears in person through Video Conferencing submits that the possession of the subject premises has been handed over to the Respondent. Learned Counsel for the Respondent does not dispute this contention. He, however, submits that the Appellant is in breach of the undertaking filed before this Court on 31.01.2024. 2.

The Appellant submits that the matter with respect to the payment to be made by the Appellant to the Respondent is now subject matter of recovery proceedings which are pending before the Trial Court. 3.

In view of the aforegoing submissions, the Appellant seeks and is granted liberty to withdraw the present Appeal. The appeal is dismissed as withdrawn.
