CRL.M.A. 1442/2024 is an application for early hearing preferred on behalf of the Petitioner on the ground that Petitioners and Respondent No.2 herein have entered into an amicable settlement of their disputes and an MOU in this regard has been executed on 13.09.2023. 2.

Mr. Amit Peswani, learned counsel appearing on behalf of Ms. Nandita Rao, learned ASC for State points out that the present petition has been filed for quashing of FIR No.151/2020 dated 19.11.2020 registered under Sections 376/354/509 IPC at P.S. Mandir Marg, on merits and therefore it cannot be quashed on ground of settlement. Faced with this, learned counsel for the Petitioners does not press the early hearing application and seeks to withdraw W.P.(CRL) 2784/2022, with liberty to file a fresh petition, on the basis of the settlement arrived at between the parties.

Accordingly, petition along with the application is disposed of as withdrawn, with liberty as prayed for, in accordance with law. 5.

Date of 13.03.2024 is cancelled.
