At the very outset, Mr. Akshay Chandra, learned counsel for appellant states that as per the instructions, the appellant/employer is no longer interested in pursuing with the present appeal. 2.

It is submitted that the employer had been burdened with a penalty of Rs. 4,88,047/- under Section 4A of Employee's Compensation Act, 1923 and pursuant to the above said direction of the learned Commissioner, the amount was deposited before the learned Commissioner by submitting a Demand Draft.

It is submitted that since the appellant is withdrawing the appeal, he would have no objection if such amount is, evidently, permitted to be withdrawn by respondent No. 1 (LRs of deceased employee). Learned counsel for respondent No.2-Inusrance Company has joined the proceeding through Video Conferencing.
