This is a petition for winding up of the respondent - company under Section 433 of the Companies Act, 1956. 2.

Learned counsel for the parties state that the petition is still at a preliminary stage. At their request, and in terms of the judgment of the Supreme Court in Action Ispat & Power Pvt. Ltd. v. Shyam Metalics & Energy Limited, [(2021) 2 SCC 641], the petition is, therefore, transferred to the National Company Law Tribunal ["NCLT"] in accordance with the Companies (Transfer of Pending Proceedings) Rules, 2016. The parties shall appear before the Registrar, NCLT (Principal Bench), on 16.01.2026 for further directions.
