Petition under Article 226/227 of the Constitution of India filed for quashing of FIR no.102/2022 under Sections 288/337/304A IPC registered at PS Dwarka North.

It is submitted in the petition that the parties have compromised initially for Rs.3,00,000/- but subsequently the matter was referred to mediation wherein the parties agreed to settle the dispute vide settlement dated 08.07.2024 at Rs.4,85,000/- to be given to the minor daughter, wife and the mother of the deceased.

Furthermore, petitioner has been giving money from time to time as and when demanded by the respondent no.2 for day-to-day needs and Rs.2,41,000/- already stands paid to her. Further through mediation the settlement dated 08.07.2024 has been arrived at Rs.4.85 lacs out of which Rs.2 lacs FDR in the name of the daughter namely Rachika Kumari Rai and Rs.1,42,500/- are given each to the wife Smt. Neetu Kumari Rai and mother of the deceased Smt. Hiramuni Devi.

The respondents, wife, mother and minor daughter are present in Court.

The petitioners and respondents all endorse the settlement and state that they have settled all their claims without any fear, threat, coercion or pressure and shall remain bound by the terms of settlement. 6.

The wife and the mother who are present in Court have also accepted that the money from time to time was given by the petitioners as and when requested by her. The settlement is accepted pursuant thereto three DDs bearing nos.000390, 000391 and 000392 in the sum of Rs.2,00,000/-, Rs.1,42,500/- and Rs.1,42,500/- respectively have been handed over to the daughter, wife and the mother.

In view of the settlement, the FIR bearing No. 102/2022 under Sections 288/337/304A IPC registered at PS Dwarka North and all the proceedings emanating therefrom are hereby quashed. 8.

It is directed that the DD of Rs.2,00,000/- given in the name of the daughter shall be deposited in the account bearing no.7301706446 of the minor Rachika Kumari Rai in Indian Bank, Kumardhubi, District Dhanbad, Jharkhand and shall be converted into an FDR to be released on attaining The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
