% 19.03.2019 The matter is received on transfer.

Vide the present petition, the petitioner seeks direction thereby directing the respondents to initiate fair, impartial and thorough preliminary inquiry on the issues mentioned in the representations filed by the petitioner in a time bound schedule under the supervision of this Court. The present petition was filed in the year 2015 and the respondents have filed various status reports which have been gone through by this Court and directions to do the needful were also given from time to time.

In the present petition, the respondent no. 1 is the Director of Enforcement of Directorate and respondent no. 2 is the Director General of Income Tax, Investigation.

It is not in dispute that respondent no. 2 is the investigating agency of the Income Tax Department and respondent nos. 5 & 6 are Assessing Authorities of the Income Tax. It is also not in dispute that respondent nos. 5 & 6 are restrained to proceed further by this Court vide the order passed in W.P. (C) no. 3393/2018 and several other writ petitions/SLPs. The respondent no. 1 has brought the status report which has been gone through by this court. I had interacted with Mr. Santosh Kumar, Assistant Director of respondent no. 1. It is stated by the Assistant Director named above that any of the authorities like CBI, Income Tax Department etc., wishes to share any kind of information, they are always ready with the same and have already shared the information, from time to time as and when the need arises.

Since the investigation is going on in proper manner, no further orders are required to be passed. This Court expects from all the investigating agencies to investigate the issues pending with them, subject to order passed by this Court/Hon'ble Supreme Court.
