This is a petition filed under Article 226 and 227 of Constitution of India read with Section 482 of CrPC seeking quashing of FIR 0429/2020, under Section 363 of Indian Penal Code and Sections 9/10 of Prohibition of Child Marriage Act, 2006 registered at Police Station Swaroop Nagar, Delhi. 2.
The father of the prosecutrix had registered a complaint for missing of his elder daughter who according to the complainant was a minor. 3.
It is an admitted case that the parties were married but there has been no consummation of the marriage.

Since the parties were not living together and the complainant does not wish to prosecute the complaint against the petitioner, I am of the view quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. This should not be treated as a legal precedent as in this case, the proceedings are quashed as the respondent has decided to put a quietus to the matter. purpose if criminal proceedings are permitted to be prosecuted any further. It is a fit case for quashing.

The parties further undertake that they shall take appropriate action to seek annulment of marriage in accordance with law. 6.
Petitioner is present in Court and has been identified by his counsel, Mr. Suman Kumar Singh.

Respondent No. 2 is present in Court and has been identified by her counsel, Mr. and Investigating Officer SI Sheetal, Police Station Swaroop Nagar.

In this view of the matter, FIR No. 0429/2020, under Sections 363 of Indian Penal Code and Section 9/10 of Prohibition of Child Marriage Act, 2006 registered at Police Station Swaroop Nagar, Delhi and proceedings pursuant thereto are hereby quashed.

The petition is disposed of accordingly.
