The present Petition has been filed on behalf of the Petitioner under Section 115 of the Code of Civil Procedure, 1908 [hereinafter referred to as "CPC"] seeking to challenge the order dated 21.09.2023 passed by learned Civil Judge, East, Karkardooma Courts [hereinafter referred to as the "Impugned Order"]. The Impugned Order is a composite order passed in a joint Application filed under Order XII Rule 6 and Order VII Rule 11 of the CPC. A review of the Application, however, reflects that the Application does not raise any contention under the provisions of Order VII Rule 11 of the CPC.

After some arguments, the learned counsel for the Petitioner seeks and is granted permission to withdraw the present Petition with liberty to file an appropriate application for redressal of his grievances. The Petition is dismissed as withdrawn with liberty as prayed for albeit in accordance with law. The pending Application stands closed. 4.
