The petitioner seeks regular bail in case FIR No.340/2013 under Sections 302/34 IPC PS Bhalaswa Dairy. Status report is on record.

I have heard the learned counsel for the parties and have examined the file.

The petitioner is in custody since 21.11.2013. Statement of the victim's mother Smt.Rasheeda has been recorded as PW-3. She has exonerated the petitioner and did not attribute any role to him in the murder of her son Sarfaraj. Learned APP was asked if there was any other incriminating evidence against the petitioner to be produced before the Trial Court.

He answered in negative.

The petitioner was granted interim bail by the Trial Court and there are no allegations of its misuse.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.
