After some hearing, learned counsel for the respondent no.1 is in agreement that the 'RMC batching plant' of the petitioner which is lying at the concerned site shall be taken away by the petitioner. 2.
Learned counsel for the petitioner submits that the same shall be taken up / removed within a period of one week from today. Learned counsel for the respondent undertakes, on instructions, that there shall be no impediment on the part of the said respondent in this regard. 3.
Respective counsel for the parties are also in agreement that if any other rented material/ equipment of the petitioner is found to be lying on the site in question upon a joint inspection to be conducted, the same shall be allowed to be removed by the petitioner.

Further, the same shall be without prejudice to the rights and contentions of the parties to avail their contractual and other legal remedies.
