The petitioner, who is serving as a Judicial Assistant in the establishment of the Principal District and Sessions Judge (HQ), Tis Hazari, has filed this writ petition seeking grant of Non-Functional Scale ["NFS"] of ₹15,600-₹39,100 (PB-III), with pre-revised grade pay of ₹5,400, with effect from 22.08.2022.

been granted NFS. The respondent has replied to his representations on 08.04.2025, stating that the concerned committee, in its meeting on 12.12.2024, deferred the petitioner's case "in view of adverse Vigilance Report". However, it was stated that considering the petitioner's fresh representation, his matter would be placed before the committee again. 3.

The contention of Ms. Rakhi Sharma, learned counsel for the petitioner, is that the petitioner has not been issued a chargesheet in any disciplinary proceedings, is presently not under suspension, and no prosecution is pending against him. In these circumstances, Ms. Sharma submits that there is no basis for denial of NFS to the petitioner. 4.

Having regard to the fact that the respondent itself has proposed that the matter will be reconsidered by the NFS Committee, I do not consider it necessary to entertain the writ petition at this stage. 5.

However, the respondent is directed to place the matter before the committee within four weeks, and if the decision is adverse, to communicate the same with reasons to the petitioner and his learned counsel within four weeks thereafter.

The rights and remedies of the parties remain reserved. 7.

The writ petition is disposed of with these directions.
