The grievance articulated by the petitioners in the present case is that the visa application of the petitioner no.2 (who is a Chinese citizen and spouse of the petitioner no.1) seeking X-2 entry type visa has been rejected multiple times.

It is submitted that the same is unjustified given that the petitioner no.2 is married to an Indian citizen (petitioner no.1) and is entitled to have a family life with her spouse.

It is further submitted that the petitioner no.1 also carries on a small business in Bengaluru with the petitioner no.2 (who had earlier stayed in India for a period of 14 years from 2008 to 2022), which is currently The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. incurring losses as the petitioner no.1 is unable to carry on her livelihood singlehandedly while taking care of her daughter who is clinically diagnosed with developmental delay.

After some hearing, the present petition is disposed of with liberty to the petitioner no.2 to submit a fresh application to the respondent. Upon submission of such application, the same shall be duly and expeditiously considered by the respondent in accordance with law and as per extant rules and guidelines.
