Having considered the submissions made by learned counsel appearing on behalf of the parties, this Court finds that there are two cases pending in the East District, Karkardooma Courts, Delhi. It was submitted that one of the cases pertains to the provisions of Protection of Women from Domestic Violence Act, 2005 and the other case pertains to an FIR lodged under Sections 498A, 406 and 34 of the Indian Penal Code, 1860. 2.
Learned counsel appearing for the petitioner then contends that if the present matter, which has been instituted by her husband, pending before the Additional Principal Judge, Family Court, West, Tis Hazari Courts, Delhi is transferred to Principal Judge, Family Court, East, Karkardooma Courts, Delhi, the petitioner would be able to appear before the said Court on the dates when other matters are listed and thus, she would not be required to apply for leave from her employment. Learned counsel appearing on behalf of the respondent strongly opposes the aforesaid submissions.

I have considered the submission made by the parties and have also perused the record.

Taking into consideration the overall facts and circumstances and in the interest of justice, the Court finds that the HMA No.1325/2020, pending before the Additional Principal Judge, Family Court, West, Tis Hazari Courts, Delhi deserves to be transferred to Principal Judge, Family Court, East, Karkardooma Courts, Delhi.

Ordered accordingly.

Let the aforesaid matter be transferred from Additional Principal Judge, Family Court, West, Tis Hazari Courts, Delhi to Principal Judge, Family Court, East, Karkardooma Courts, Delhi. 8.
