Mr Pawan Kumar Sharma, Advocate appears for the appellant states that the parties have settled their inter se disputes arising from the impugned judgment before the learned Executing Court in Ex.(COMM) No.142/2025 captioned M/s Bosch Limited v. Wazir Singh wherein on 05.08.2025, following order was passed:
"Matter is today fixed for report regarding encashment of cheque of Rs.10 lacs/ payment of balance amount by JD.
Counsel for DH submits that the cheque of Rs.10 lakhs handed over by JD on 03.07.2025 has been cleared.
Today JD has handed over three post-dated cheques bearing no.000007 dated 15.09.2025 for Rs.5 lakhs, no.000006 dated 05.10.2025 for Rs.5 lakhs and no.000008 dated 15.11.2025 for Rs.6 lakhs, all drawn on HDFC Bank, Karol Bagh, to the Counsel for DH towards full and final settlement of the decretal amount. Photocopy of the said cheques is also retained on record.

be allowed to withdraw the present execution as satisfied.

Accordingly, the appeal is dismissed as withdrawn. The request of Mr Sharma, for refund of the Court fee shall be considered by the Registry, as per law.
