Mr. Manu Mishra, Ld. Counsel fairly states that investigation is complete and all the co-accused have since been enlarged on bail and, therefore, he does not want to press the present petition and seeks permission to withdraw the present petition. However, he has made a request that an order may be passed that any observation made in the impugned order may not affect the merits of the case.

The statement made by the Ld. Counsel is taken on record and present petition is dismissed as withdrawn. It is clarified that any observation made by the Ld. Special Judge while passing the impugned order dated 14.11.2022 shall not be deemed to be an expression on the merits of the case.
