This petition is filed by the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties. 2.

Learned counsels for the parties, on instructions, jointly submit that the Petitioner will approach the Dispute Resolution Board ('DRB') as a Pre Reference Mechanism. Respondents will provide a list of the Members for constitution of the DRB and after the DRB is constituted with the consent of the Petitioner, the disputes will be referred and a decision will be taken by the DRB positively, within a maximum period of 42 days as per the clause. 3.

Needless to state in case for any reason, the decision is not favourable to the Petitioner, Petitioner will be at liberty to take recourse to arbitration. 4.
