Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the Petitioners for quashing of FIR No. 0504/2020 registered under Sections 354/34 IPC at P.S. Badarpur and the proceedings emanating therefrom in terms of the MOU dated 13.06.2025. 2.

The FIR No. 0504/2020 was got registered under Sections 354/34 IPC at P.S. Badarpur on the basis of complaint made by the Complainant. According to the Complainant, her mobile was stolen and there was some fight which took place with the Petitioners on 30.10.2020 at about 11.30 AM.

The Petitioner and the Respondent No. 2 are present before this Court in person and have been identified by their Counsel and Investigating Officer concerned.

It is submitted that the Petitioners and Respondent No. 2 are distantly related to each other about which the Complainant came to know from her parents who visited after the incident.

It is submitted that the parties have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed. 6.

The parties have endorsed the amicable MOU dated 13.06.2025 and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Settlement.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to the parties who are known to each other and are residing in the same locality, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. 8.

In view of the aforesaid, the FIR No. 0504/2020 registered under Sections 354/34 IPC at P.S. Badarpur and the proceedings emanating therefrom are hereby quashed.
